WHEREAS, In Spring Semester 1999 the Academic Senate of Humboldt State University passed the revised Student Grievance Procedures which included two sections: Section One for Grievance Procedures for Academic and Other Issues not Related to Discrimination or Misconduct and Section Two for Grievance Procedures for Discrimination or Misconduct Issues; and
WHEREAS, After consulting with the Office of General Counsel, the two sections have been separated, and it is recommended that Section One become the Student Grievance Procedures for Academic and Other Issues not Related to Discrimination or Misconduct, and that a separate document applying to all members of the academic community be created to deal with issues of discrimination or misconduct; and
WHEREAS, Changes were recommended to Section One Grievance Procedures for Academic and Other Issues not Related to Discrimination or Misconduct which include the following:
Original language: Wherever a time limit is provided by this document, the grievant or respondent at that level may request from the Tribunal Chair or appropriate administrator an extension of the time period due to serious and compelling reasons.
New language: Once a grievance is timely filed, the processing of that grievance shall be held in abeyance when the respondent is unavailable due to leave‑of‑absence, sabbatical leave, etc.; and
WHEREAS, This change in language removes the grievant's protection of the right to abeyance under unusual circumstances; therefore, be it
RESOLVED: That the Academic Senate of Humboldt State University approve the separation of Section One and Section Two and the creation of a Student Grievance Procedures which incorporates only Section One of the previous document; and be it further
RESOLVED: That the Academic Senate of Humboldt State University approve the revised Student Grievance Procedures with the exception of the change in language concerning time limits; and be it further
RESOLVED: That the Academic Senate of Humboldt State University recommend that the original language regarding time limits be reinstated in the Revised Student Grievance Procedures; and be it further
RESOLVED: That the Academic Senate of Humboldt State University recommend the development, with Senate participation, of a Grievance Procedure for Discrimination and Misconduct based on Section Two of the previously approved Student Grievance Procedures.
